The crime of theft is a very broad criminal offense. Theft is taking property from another person without their permission. There are various ways in which a person can steal, and each way pertains to its own specific crime. Just so there is no confusion, be aware that ‘larceny’ and ‘theft,’ for purposes of the California Penal Code, are the exact same thing. The term ‘theft’ is the more modern and common term used today.


Theft crimes may be prosecuted as a misdemeanor or a felony offense. The criminal charges will usually depend upon the dollar value of the stolen property, the location of the crime, and the means by which the theft was carried out.  For example, if a person used a weapon while committing a theft crime, he/she may be subject to enhanced theft charges and legal penalties, if convicted.


Theft is broken down into two categories: grand theft and petty theft. Theft is considered grand theft if the value of the property or services that were wrongly taken is more than $400. Any theft for property or services valued under $400 is considered petty theft. Often times a charge of petty theft with a prior theft on one’s record can demand elevated punishments.
