Charges: Ct. 1 – First Degree Murder, with Criminal Street Gang (Mongol MC), prior prison term, and weapon (15 inch Boone Knife used by another) enhancements.

Exposure: 27 years to Life in State Prison

RESULTS: After thorough investigation and preparation, at Preliminary Hearing, negotiated plea to 3 years State Prison sentence. Pled to 192 PC – Voluntary Manslaughter, with dismissal of all enhancements.

RESULTS: After thorough preparation before preliminary hearing, negotiated plea to 242 PC – simple battery. “Terminal disposition” – no fine, no time in jail, no sex registration, no probation.

Exposure: 10 years, 4 months with Deportation to El Salvador. This case arises out of an attempted murder investigation where LAPD investigating officers believed that my client was the shot caller for the murder. LAPD arrested my client with the stated purpose to squeeze him to give up the shooter or they would seek state prison time and make sure my client would be deported to El Salvador.

RESULTS: All charges dismissed after a preliminary hearing and granting of extensive 995 written motion to dismiss for insufficient evidence introduced at preliminary examination.

RESULTS: Following a 7 week preliminary hearing – ALL charges were dismissed with judicial factual findings preventing the DDA from refilling the same criminal charges in the future.

Charge: Corporal injury to spouse.

Exposure: 1 year Jail; more importantly, defendant was and is a Federal Correctional Counselor with a PhD in psychology who must be allowed to carry a firearm in the course of his employment. Conviction would have prohibited him from carrying a firearm in law enforcement, which would have resulted in the loss of a then nine (9) year job with the US Department of Justice, Bureau of Prisons.

RESULTS: DA offered 10 years State Prison which four (4) previous court- appointed attorneys all urged client to accept. After two (2) week Jury Trial, found “NOT GUILTY” VERDICT on all three counts


People v. Manuel ORTIZ

East Los Angeles Courthouse

Charges:

Ct 1 – Driving Under the Influence (DUI) and allegation that defendant willfully refused to submit to blood alcohol test with Prior DUI Conviction.

Exposure: 1 year county jail and California Driver’s License Suspension for 2 years because of REFUSAL and prior conviction.

RESULTS: DA offered wet reckless and dismiss the “refusal” allegation. However court disposition would not be binding on then pending DMV hearing. Client was three years away from retirement. Existing job required Class “A” driver’s license. If convicted and/or DMV suspended license would have lost job, lost retirement pension. According to client would have lost home, lost marriage. After a Jury Trial All charged dismissed.

DMV Hearing: Following a two hour hearing, Hearing Officer granted “Set Aside of California Driver’s License Suspension”, meaning client kept his Class “A” driver’s license, his job, his pension, his home and his marriage.

RESULTS: Faced felony charge because of the four (4) prior DUI convictions. Extensive written MOTION GRANTED dismissing all four (4) prior convictions on grounds Constitutionally Invalid. Client sentenced to first time DUI standard disposition with no jail time.
